Commissioner for Oaths Fees

Cimmissioner for Oath fees are notionally fixed and prescribed in legislation.

The following fees are laid down in the Commissioners for Oaths (Fees) Order 1993/2297, which is the standard specifically directing solicitors on charging.

* £5.00 for taking an affidavit, declaration or an affirmation
* £2.00 for each exhibit referred to in the affidavit or each schedule in the affidavit that needs to be marked.

The fees are to be inclusive of VAT where applicable.

Now these are the proper prescribed fees for ‘swearing oaths’ for affidavits.

Just in case there are any additional charges or you are not having the oath taken by a solicitor it is always recommended to get a quote for the job beforehand. It is better to know for sure what fee is to be charged.

As it is about 18 years since the fee rate was increased it is probably not at all surprising that not all solicitor commissioner for oaths want to do this work.

It represents a very low level of charging compared to normal solicitor fees which are rarely less than £150 + VAT per hour. The time to take an affidavit is likely to be anything around 10 minutes taking all things into account so if you do the maths they would probably like to charge a lot more.

So the fees at the level prescribed are in fact quite a cheap legal service.
